Account terms

Each salon or organization signs up for one keshi account. The person who creates the account is responsible for the accuracy of their salon's information and for managing staff access within the dashboard, including inviting and removing managers.

Acceptable use

You may not use keshi for any unlawful purpose, attempt to reverse engineer the service, or interfere with its normal operation. keshi may suspend access to protect the platform or other salons.

SMS inbox use. The SMS inbox (a Pro-tier feature) may only be used for transactional, appointment-related communication with a salon's own customers who have an existing booking relationship. Marketing, promotional, or bulk/unsolicited messaging through the SMS inbox is strictly prohibited. The salon owner is solely responsible for the content of messages they send and for compliance with TCPA (US) and CASL (Canada) requirements. Violating this policy is grounds for immediate account termination.

Payment terms

The Free tier has no charge. The Pro tier is billed through Stripe, monthly or annually, and renews automatically until you cancel. A new organization gets one 30-day free trial of Pro; canceling Pro forfeits the trial on any later upgrade. Pro includes 300 SMS per month; additional SMS are billed per message at the rate shown on the billing page.

You can cancel at any time from the billing page. Fees already paid are non-refundable except where the law requires otherwise. When Pro ends, whether by cancellation or an unpaid trial, the Free tier limits apply: every staff member is disabled for booking until you re-enable one. Prices may change with at least 30 days' notice.

Your customers and your responsibilities

Your customers' personal information belongs to your salon. You are responsible for it: telling your customers how you use their data, getting any consent the law requires, and answering their access and deletion requests. keshi processes this data on your behalf only to run the service.

keshi provides software only. It is not a party to any service, sale, or appointment between you and your customers. You are solely responsible for the services you provide, their prices, cancellations, no-shows, refunds, and any injury, loss, or dispute arising from them.

Indemnification

You will defend and indemnify keshi and its owner against any claim, fine, penalty, or cost (including reasonable legal fees) arising from your content, the messages you send through keshi, your breach of these Terms, your violation of law (including TCPA, CASL, and privacy law), or the services you provide to your customers.

Disclaimers

The service is provided "as is" and "as available" without warranty of any kind, including any warranty of uninterrupted or error-free operation. keshi does not guarantee that any email, SMS, reminder, or notification will be delivered or received on time, or that any data will never be lost. Keep your own record of anything business-critical.

Limitation of liability

To the maximum extent permitted by law, keshi's total liability for all claims is limited to the greater of the amount you paid for the service in the preceding 12 months and CA$100. keshi is not liable for indirect, incidental, special, or consequential damages, or for lost profits, bookings, or revenue.

Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles. Any dispute arising under these Terms is subject to the exclusive jurisdiction of the courts of Ontario, Canada.

Termination

Either party may terminate at any time. keshi may suspend or terminate accounts for violations of these Terms — including the SMS misuse clause above — or for non-payment.

Changes to these Terms

We may update these Terms. For material changes we will notify account owners by email at least 30 days before they take effect. Continued use after that date means you accept the updated Terms.

General

keshi owns the service and its software; you keep ownership of your own content and grant keshi the right to host and process it to run the service. If any part of these Terms is unenforceable, the rest remains in effect. These Terms are the entire agreement between you and keshi about the service. You may not assign them without our consent. Neither party is liable for delays caused by events beyond its reasonable control.
